Response to FTC Challenge

supplementscasestudy_copyA major dietary supplement manufacturer was issued a complaint by the Federal Trade Commission (FTC) involving its marketing claims so the company turned to ISS for support and guidance.

Working closely with legal counsel, ISS developed a comprehensive strategy for an effective response to the challenge.  The multi-faceted approach was designed to demonstrate that the client was responsibly marketing its product based on competent and reliable scientific support for the advertising claims.

The first phase of the response involved the compilation, review, and strategic assessment of all available scientific data relevant to the claims; regardless if it was supportive of the marketing claims. Then ISS crafted an expert report articulating the relevant arguments in a synthesized and comprehensive fashion. Finally, one of our senior scientists testified before the FTC regarding the scientific data supporting the claims and offered persuasive arguments that the claims were well supported by the available scientific evidence.

The outcome of the hearing resulted in an exceptionally favorable ruling for the client. Millions of dollars in fines were avoided and the client was able to continue marketing its product with minimal adjustments to its advertising campaign.
